Contract of Agreement
It is mutually agreed that the following terms of agreement form an integral part of this contract and that no variation or modification of this contract shall be effective unless accepted by Dan Spratt (DS MEDIA) in writing.
PAYMENT:
To guarantee your booking a deposit of £300 is required and the full balance can be paid any time up to 4 weeks before your wedding date.
Any bank charges incurred due to returned cheques will be charged to the client.
COVERAGE:
The videographer cannot be held responsible for the lack of coverage caused by the bride, the groom or the wedding party not being on time. Or by the Church, Registry Office, or Licensed place of wedding restrictions regarding videography.
WEATHER CHANGES: Weather permitting, the wedding videography will be filmed as agreed. In the event of any adverse weather conditions, the videographer will make the necessary changes in the video session in consultation with the couple, and cannot be held responsible for any disappointment caused by the weather. However, the videographer will do his best to produce coverage of the wedding within the time allocated to him.
REQUESTED VIDEO:
The videographer will honour all video footage requested and agreed in advance, provided the following factors are met: Weather and allocated time permitting, availability and co-operation of the person/s concerned.
EXCLUSIVITY:
Dan Spratt (DS MEDIA) shall be the sole professional videographer at the venues specified.
COPYRIGHT:
The Copyright of all the video produced is retained by Dan Spratt (DS MEDIA) and it is a criminal offence to make copies of them by any means including video under the terms of the COPYRIGHT, DESIGNS and PATENTS ACTS 1988.
Upon receiving your wedding video, you also receive Personal Usage Rights – for example – using them on your social media, giving copies to friends and family for their personal use and display. There is no time or geographic limit on this Personal licence. Your licence Excludes any Commercial use. Examples of commercial usage include but are not limited to; uploading to a stock video library, re-selling, publishing in online media or promoting a commercial enterprise. The copyright in all video whether stored digitally or otherwise and any computer program including any source or object code, computer file or printed documentation relating to such video remains our property, but you have a licence to use them for Personal, non-commercial use. If, at any stage, you are unsure as to whether a use you are putting your images to is considered commercial, you agree to contact us to check your rights.
Dan Spratt (DS MEDIA) reserves the right to use or display any video created as part of this Contract as part of our portfolio, at exhibitions, or for marketing purposes.
DIGITAL MEDIA:
Dan Spratt (DS MEDIA) withdraws all responsibility of the digital files once these are passed on to the client, however we keep your digital media for 12 months. You are advised to make a back-up of the digital wedding video you receive from us to protect yourselves in the event of loss, digital corruption or theft.
PERSONAL ACCIDENT:
Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said personsʼ own risk. Dan Spratt (DS MEDIA) cannot be held responsible for any personal accidents during a video shoot.
You agree to be responsible for any injury, loss or damage caused to the videographer/s or equipment caused by your guests.
LIABILITY:
Dan Spratt (DS MEDIA) will exercise the reasonable skill care and judgment that you would expect of a professional videographer but we shall not be liable for events beyond our reasonable control nor for loss which is indirect or consequential. Under no circumstances will our liability to you, whether for breach of contract, negligence, breach of statutory duty or otherwise exceed the total amount that you have paid to us under this Contract. Our fees have been calculated on this basis. If you wish to have additional cover we would recommend that you consider taking out a policy of insurance. Nothing in this Contract shall exclude our liability for death or personal injury caused by us or those for whose acts we are responsible.
CANCELLATION: A full unconditional refund policy exists for a period of 14 days from receipt of the contract and payment. After that date, booking fee refunds are at the discretion of Dan Spratt (DS MEDIA).
If Dan Spratt (DS MEDIA) has to cancel this contract for reasons beyond their control (death, injury, serious illness etc) their liability shall be limited to a full refund of all monies paid.
In the unlikely event that Dan Spratt (DS MEDIA) cannot provide wedding coverage due to Illness, injury or death, all reasonable efforts will be made to find a suitable replacement videographer and I agree to terminate this contract and a full refund will be processed in 10 working days.
In the highly unlikely event of total equipment or technological failure i.e. during filming or editing, the Videographerʼs liability shall be limited to a full refund of all money paid. Your statutory rights are not affected, and Dan Spratt (DS MEDIA) has full Public Liability and Professional Indemnity Insurance in place.
You may cancel the Contract at any time by notice in writing. You will then be liable to pay Dan Spratt Videography compensation based on a percentage of the Package Fee depending upon when the notice is received:
121 days or more – Deposit only
91 – 120 days – 50%
61 – 90 days – 60%
31 – 60 days – 75%
0 – 30 days – 100%
If the date of the wedding is postponed, we may at our sole discretion (which we will exercise reasonably having regard to our ability to obtain alternative work on the first agreed date and availability on the second date) agree not to treat the Contract as being cancelled but to provide the services on the postponed date and apply all monies paid by you towards the fees for that day.
All terms of this agreement are understood and agreed upon. The receipt of a deposit sent to Dan Spratt (DS MEDIA) is your acceptance of the above terms.
